Welcome to Kiboko Kenya Safaris. These Terms and Conditions govern your use of our website and the booking of any safari, tour, or travel service offered by Kiboko Kenya Safaris. By accessing our website or making a booking, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use our services.
Kiboko Kenya Safaris is a Kenya-registered safari company operating under the laws of the Republic of Kenya. All agreements entered into with us are governed by Kenyan law.
1. Definitions
“Company”, “We”, “Us”, “Our” refers to Kiboko Kenya Safaris.
“Client”, “You”, “Your” refers to any individual or group that accesses our website, makes an enquiry, or books a tour with us.
“Safari / Tour / Service” refers to any travel itinerary, game drive, transfer, accommodation arrangement, or travel package offered by Kiboko Kenya Safaris.
“Booking” means a confirmed reservation for any of our services.
2. Booking & Confirmation
2.1 How to Book
Bookings may be made via our website, email, phone, or through an authorised travel agent. A booking is only confirmed upon receipt of a written confirmation from Kiboko Kenya Safaris and the required deposit payment.
2.2 Deposit Requirements
A non-refundable deposit of 30% of the total tour cost is required to secure a booking. The remaining balance is due no later than 60 days prior to the tour departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.
2.3 Booking on Behalf of Others
If you are booking on behalf of a group, you are responsible for ensuring that all members of your group are aware of and agree to these Terms and Conditions. You are liable for full payment on behalf of your group.
3. Pricing & Payment
3.1 Pricing
All prices are quoted in US Dollars (USD) unless otherwise stated. Prices include services specified in the itinerary and exclude international flights, travel insurance, tips/gratuities, visas, and personal expenses, unless explicitly stated.
3.2 Price Changes
We reserve the right to revise prices at any time before a booking is confirmed. After confirmation, prices are guaranteed except in cases of significant changes in government taxes, park fees, fuel levies, or currency fluctuations exceeding 10%. We will notify you of any such changes promptly.
3.3 Park Fees
Kenya Wildlife Service (KWS) and other park authority fees are subject to change without notice. Any increases in park fees between booking and travel date will be passed on to the client.
3.4 Payment Methods
We accept payment via bank transfer, M-Pesa, and major credit/debit cards. Bank charges and transaction fees are the responsibility of the client.
4. Cancellation & Refund Policy
4.1 Cancellation by the Client
All cancellations must be received in writing (email is accepted). The following cancellation fees apply based on the number of days before departure:
- More than 60 days: Loss of deposit only (30%)
- 30–59 days: 50% of total tour cost
- 15–29 days: 75% of total tour cost
- Less than 15 days or no-show: 100% of total tour cost
4.2 Cancellation by Kiboko Kenya Safaris
We reserve the right to cancel any tour due to insufficient bookings, force majeure, safety concerns, or circumstances beyond our control. In such cases, we will offer a full refund or an alternative tour of equivalent value. We are not responsible for any additional expenses incurred by the client such as flights, visas, or accommodation outside the tour package.
4.3 No Refunds for Unused Services
No refunds will be given for unused portions of a tour including accommodation, meals, activities, or transport, whether due to late arrival, early departure, or personal choice.
5. Amendments & Changes
Requests to amend a confirmed booking (e.g., change of dates, itinerary, or number of travellers) must be made in writing. We will endeavour to accommodate changes subject to availability. An amendment fee of USD 50 per change may apply. Changes made within 30 days of departure will be treated as cancellations and re-bookings and cancellation fees may apply.
6. Travel Documents & Visas
It is your sole responsibility to ensure you hold a valid passport (with at least 6 months validity beyond your travel dates) and all required visas and permits for Kenya and any other countries included in your itinerary. Kiboko Kenya Safaris will not be held liable for any costs, delays, or denied entry resulting from inadequate documentation.
Kenyan visa requirements may change. We recommend checking the official Kenya e-Citizen portal (www.ecitizen.go.ke) for the most current requirements.
7. Health, Fitness & Safety
7.1 Health Requirements
Kenya is a malaria-risk destination. Clients are strongly advised to consult a qualified travel health professional prior to departure. Yellow fever vaccination may be required depending on your country of origin. We recommend you research the latest health advisories from your national health authority.
7.2 Physical Fitness
Some of our safari activities — including bush walks, trekking, and boat safaris — require a reasonable level of physical fitness. You must inform us of any medical conditions, disabilities, or dietary requirements at the time of booking. We reserve the right to decline participation in certain activities if we reasonably believe it would pose a risk to your health or safety.
7.3 Wildlife Encounters
Safari activities involve interaction with wildlife in their natural habitat. Wildlife behaviour is unpredictable and inherently involves risk. You agree to follow all safety instructions given by your guide at all times. Kiboko Kenya Safaris, its partners, and guides will not be liable for any injury, loss, or death resulting from failure to follow safety instructions or from the inherent risks of wildlife encounters.
7.4 Vehicle Safety
All clients must wear seatbelts where fitted and remain seated during game drives unless instructed otherwise by the guide. Standing through open roofs or hanging out of vehicles is at your own risk.
8. Travel Insurance
Comprehensive travel insurance is strongly recommended and, for certain high-risk activities, may be required. Your insurance should cover medical emergencies, evacuation, trip cancellation, personal liability, and loss of personal belongings. Kiboko Kenya Safaris will not be liable for costs that would otherwise be covered by travel insurance.
9. Itinerary Changes
Kiboko Kenya Safaris reserves the right to alter itineraries at any time due to road conditions, weather, wildlife movements, park authority regulations, safety concerns, or force majeure. We will always endeavour to provide an equivalent or better alternative. No refunds will be given for necessary itinerary changes caused by circumstances beyond our control.
10. Liability
10.1 Limitation of Liability
Kiboko Kenya Safaris acts as an agent for various service providers including hotels, lodges, airlines, and activity operators. We are not liable for any act, omission, neglect, or default on the part of these third-party providers.
To the maximum extent permitted by applicable Kenyan law, our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the affected service.
10.2 Exclusions
We are not liable for any loss, injury, or damage caused by:
- Your own negligence or failure to follow instructions
- Theft or loss of personal belongings
- Acts of God, natural disasters, or force majeure events
- Government actions, border closures, or travel advisories
- Third-party service providers
- Civil unrest, terrorism, or war
11. Force Majeure
Neither party will be in breach of these Terms or liable for any failure to perform their obligations where such failure results from circumstances beyond their reasonable control, including but not limited to: acts of God, extreme weather, pandemics, government actions, strikes, civil unrest, or airport closures. In such circumstances, we will endeavour to rebook or provide alternatives. Refunds will be assessed on a case-by-case basis.
12. Code of Conduct & Responsible Tourism
Kiboko Kenya Safaris is committed to responsible, ethical, and sustainable tourism. We ask all clients to:
- Respect local communities, customs, and traditions
- Not disturb or harass wildlife at any time
- Follow all park rules and guide instructions
- Not purchase illegal wildlife products or souvenirs made from protected species
- Minimise waste and leave no trace in natural areas
We reserve the right to terminate a safari without refund if a client behaves in a manner that is abusive, illegal, or poses a risk to others, wildlife, or the environment.
13. Photography & Privacy
Photography of local communities, individuals, or private property requires the consent of the subject. Kiboko Kenya Safaris and its guides may take photographs during tours for marketing and social media purposes. If you do not wish to be photographed, please notify your guide at the start of the tour.
Your personal data collected during booking will be processed in accordance with our Privacy Policy and applicable Kenyan data protection law (Data Protection Act, 2019).
14. Website Use
14.1 Intellectual Property
All content on this website — including text, images, logos, videos, and itineraries — is the property of Kiboko Kenya Safaris and is protected by copyright. You may not reproduce, distribute, or use any content for commercial purposes without our prior written consent.
14.2 Accuracy of Information
We endeavour to keep website content accurate and up to date. However, we cannot guarantee that all information, including prices, availability, and itinerary details, is current at all times. Please contact us to confirm details before booking.
14.3 Third-Party Links
Our website may contain links to third-party websites. These are provided for convenience only. We are not responsible for the content, accuracy, or privacy practices of third-party sites.
15. Complaints
If you have a complaint during your tour, please raise it immediately with your guide or our operations team so we can attempt to resolve it. Complaints raised after the tour must be submitted in writing within 30 days of your return. We take all complaints seriously and will respond within 14 business days.

16. Governing Law & Disputes
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or your booking will first be subject to good-faith mediation. If mediation fails, disputes will be resolved in the courts of Kenya.
17. Amendments to These Terms
Kiboko Kenya Safaris reserves the right to update these Terms and Conditions at any time. Changes will be published on our website with an updated effective date. Your continued use of our website or services after changes are published constitutes your acceptance of the updated terms.
